Terms of Service
The rules governing how organisers and attendees use Utsavs — written to be understood, not just signed.
1. Acceptance of Terms
By accessing or using Utsavs (utsavs.app), you agree to be bound by these Terms of Service and all applicable laws and regulations of India. If you do not agree to these terms, you must stop using the platform immediately. These terms apply to all users — organisers, attendees, and visitors.
2. Who We Are
Utsavs is an online event management and ticketing platform designed for event creators and attendees in India. The platform allows organisers to create event pages, sell tickets, manage registrations, and communicate with attendees. Attendees use Utsavs to discover events and complete registrations.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately if you suspect unauthorised access to your account.
- Accounts are personal and may not be transferred or sold to another person.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Organiser Responsibilities
When you create and publish an event on Utsavs, you accept full responsibility for that event. As an organiser, you agree to:
- Provide truthful, accurate, and complete event details including date, time, venue, and pricing.
- Deliver the event as described on the registration page.
- Communicate any changes, cancellations, or delays to registered attendees promptly.
- Handle attendee refunds in accordance with your stated refund policy and our Refund Policy.
- Comply with all applicable Indian laws, including those related to public gatherings, venue licensing, and taxation.
- Not use the platform to collect registrations for events you do not intend to deliver.
- Not misrepresent the nature, scale, or credibility of your event.
5. Attendee Responsibilities
- Provide accurate personal details (name, email) when registering for an event.
- Review the event details and the organiser's refund policy before completing registration.
- Attend or participate in accordance with any rules or requirements set by the organiser.
- Treat event staff, organisers, and other attendees respectfully.
- Not misuse or share QR tickets issued to you.
6. Payments and Fees
Organisers set the ticket price. For paid tickets, Utsavs adds a platform fee (currently 3% of the original ticket price) at checkout. This fee is disclosed to attendees before payment is confirmed. When a promo code or discount is applied, the platform fee is still calculated on the original (undiscounted) ticket price.
All payments are processed by Razorpay, a PCI DSS-compliant payment gateway. Utsavs does not store your card, UPI, or bank details. Organiser payouts are handled by Razorpay in accordance with their terms.
Free events carry no ticket price. Utsavs does not charge attendees or organisers for free-ticket registrations.
Organisers receive 100% of the ticket price paid by the attendee (after any discount the organiser chose to offer). Platform fees are collected separately from attendees and do not reduce the organiser's payout. Payout schedules are governed by Razorpay's settlement timelines.
7. Promo Codes and Discounts
Organisers may create promo codes (coupons) for their events. Promo codes offer either a percentage or flat discount on the ticket price. Each promo code may have a maximum number of uses and an expiry date set by the organiser.
When a promo code is applied, the platform fee (3%) is calculated on the original ticket price, not the discounted price. For example, if a ticket costs Rs. 1,000 and a 20% discount is applied, the attendee pays Rs. 800 (discounted ticket) + Rs. 30 (3% of Rs. 1,000) = Rs. 830. The organiser receives Rs. 800.
Organisers are solely responsible for the promo codes they create. Utsavs does not compensate organisers for discounts offered through their own promo codes. Discounts reduce the organiser's payout, not the platform fee.
8. Organiser Plans
Organisers may purchase a plan (Starter, Growth, or Pro) to access platform features such as event creation slots and QR ticket email delivery. Plans are one-time purchases — there is no monthly or recurring charge.
Plans remain active until the included limits (event slots, QR email quota) are fully used. There is no time-based expiry. Once limits are exhausted, the organiser may purchase a new plan or upgrade.
Plan purchases are non-refundable. By purchasing a plan, you acknowledge that it is a one-time digital purchase and that you have reviewed the plan features before payment.
9. Refunds and Cancellations
Refund responsibility rests primarily with the organiser. For full details, please read our dedicated Refund Policy at utsavs.app/refund. In summary:
- Free event registrations carry no monetary refund obligation.
- For paid tickets, the organiser's stated refund policy governs whether a refund is issued.
- Platform fees are non-refundable unless the event is cancelled by the organiser.
- If an organiser cancels an event, attendees are entitled to a full refund of the ticket price.
- If a discounted ticket is refunded, the refund amount is the discounted price paid — not the original price.
- Utsavs may intervene in disputes to protect attendee interests where there is clear evidence of organiser non-delivery.
10. Prohibited Activities
You may not use Utsavs for any of the following:
- Creating fraudulent, misleading, or deceptive event listings.
- Collecting registrations or payments for events that will not take place.
- Impersonating another person, organisation, or brand.
- Uploading content that is illegal, defamatory, harassing, or infringes third-party rights.
- Attempting to bypass, reverse-engineer, or tamper with any part of the platform.
- Scraping, crawling, or automated data extraction without prior written consent.
- Selling or reselling tickets purchased on Utsavs for profit without organiser authorisation.
- Abusing promo codes by creating fake accounts, sharing private codes publicly, or exploiting discount systems.
11. Intellectual Property
The Utsavs name, logo, platform design, and software are the intellectual property of Utsavs and its creators. Organisers retain ownership of the event content they upload (descriptions, images, banners) but grant Utsavs a non-exclusive licence to display and reproduce that content on the platform for the purpose of promoting and delivering the event.
12. Content Standards
All content published on Utsavs — including event titles, descriptions, and banners — must:
- Be accurate and not misleading.
- Not contain hate speech, explicit content, or material that incites violence.
- Not violate any applicable Indian law, including the Information Technology Act, 2000.
- Respect the intellectual property and privacy rights of third parties.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Utsavs is not liable for: any indirect, incidental, consequential, or punitive damages; loss of revenue or profit arising from use of the platform; events that are cancelled, postponed, or materially changed by organisers; technical downtime or service interruptions; or actions taken by third-party payment processors. Our total liability for any claim arising from your use of Utsavs shall not exceed the amount of fees paid by you to Utsavs in the six months preceding the claim.
14. Indemnification
You agree to indemnify and hold Utsavs harmless from any claims, losses, or damages (including legal fees) arising from your violation of these terms, your event content, or your conduct on or through the platform.
15. Third-Party Services
Utsavs integrates with third-party services including Razorpay (payments), Supabase (infrastructure), and Resend (email delivery). Your use of these services through Utsavs is subject to their respective terms and privacy policies. We are not responsible for the conduct or availability of these third-party services.
16. Modifications
We may update these Terms of Service from time to time. Material changes will be reflected with an updated date at the top of this page. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
17. Governing Law and Disputes
These terms are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these terms or the use of Utsavs shall be subject to the exclusive jurisdiction of the courts in India. We encourage you to contact us first to resolve any dispute amicably.
